Privacy Policy for ComparePhotos

No data protection officer has been appointed, as the statutory conditions requiring one are not met.

2. Overview

This app processes your photos exclusively on your device. We do not operate any servers, collect no usage data and pass nothing on to third parties.

This statement describes in detail which data is processed where, in which cases something leaves your device, and what rights you have.

3. Access to your photo library

ComparePhotos needs access to your photo library in order to display, compare and manage photos.

• Access is granted only after your explicit permission through the iOS prompt. You can revoke it at any time in the iOS settings, or limit it to selected photos.
• Viewing and editing happen on your device. Your photos are not transmitted to us.
• If a photo exists only in iCloud, iOS downloads it from Apple for display. This is a retrieval from your own iCloud library and is subject to Apple's privacy policy.
• Deleting and moving act directly on your photo library and are permanent.

4. Data on your device

The app stores the following on your device:

• Your appearance and control settings
• A cache for thumbnails. It exists in memory only and is discarded when the app quits.
• When sharing: full-resolution copies of the selected photos in a temporary folder. These copies are deleted as soon as the share sheet is closed, and at the latest before the next share.

This data does not leave your device.

5. Map and location data

If a photo contains location information, the metadata view shows a map of where it was taken.

• To draw the map, iOS sends the displayed map region to Apple in order to load the map tiles. The approximate location of your photo therefore leaves the device. The photo itself is not transmitted.
• The same applies when you tap the map and the location opens in Apple Maps.
• Apple's privacy policy applies to this. We never learn this data.
• The app does not request your current location and needs no permission for it. Photos without location information show no map.

6. Sharing photos

When you share photos, the app hands the original files to the destination you choose, such as a messaging app, another device or a cloud service.

• The originals contain all embedded metadata, including capture time, camera model and, where present, the location.
• What happens to the data at the destination is governed by that provider. We have no influence over it.
• Sharing is always initiated by you. The app never shares anything on its own.

7. Contacting us by email

If you write to us at the address given in the legal notice, we process your email address and the content of your message in order to answer your enquiry.

• The legal basis is our legitimate interest in answering your enquiry (Art. 6(1)(f) GDPR).
• We delete your message once the enquiry has been dealt with and no statutory retention periods apply.
• The message is neither used for advertising nor passed on to third parties.

8. Legal bases

• Access to your photo library is based on your consent, given through the iOS prompt (Art. 6(1)(a) GDPR). You can withdraw it at any time in the iOS settings.
• Since processing takes place entirely on your device and no data reaches us, there is no processing by us in that respect.

9. Analytics and crash reports

The app itself collects no usage data and includes no analytics services.

If you have agreed to sharing in the iOS settings under “Privacy & Security” > “Analytics & Improvements”, Apple may provide us with anonymised crash reports. We use them solely for troubleshooting. You can withdraw your consent there at any time.

10. Your rights

Under the General Data Protection Regulation (GDPR) you have the following rights:

• Access to the data stored about you
• Rectification of inaccurate data
• Erasure of your data
• Restriction of processing
• Objection to processing
• Portability of your data in a machine-readable format

Please note: since the app transmits no data to us, we normally hold no personal data about you. Any access request can therefore only cover data that became known to us through you contacting us.

An email to the address above is enough to exercise your rights.

11. Data security

We implement appropriate technical and organisational security measures to protect your data from loss, misuse or unauthorised access. Since data processing mainly takes place on your device, the security of your device also contributes significantly to the protection of your data.

12. Changes to this privacy policy

We adjust this statement when the app or the legal requirements change. The current version is available in the app under “Info” > “Privacy” and at https://software.behpunktdesign.de/comparephotos/privacy/. The date at the beginning of the statement shows when it was last updated.

13. Right to lodge a complaint

You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your residence, your place of work or the place of the alleged infringement. The authority competent for us is the Independent Centre for Privacy Protection Schleswig-Holstein (ULD), Holstenstraße 98, 24103 Kiel, Germany.
